What Missouri Law Prohibits Under § 579.045

This list isn’t exhaustive, but an accusation alone doesn’t establish guilt. The prosecution must prove the elements of the charged offense, including the required knowledge and connection to fraud. A record discrepancy or unusual prescription history, without evidence of knowing conduct, may not satisfy that burden.

Fraudulently attempting to obtain a controlled substance is classified as a Class E felony in Missouri. The general sentencing statutes authorize up to four years in prison and a fine of up to $10,000 for this felony classification.
