First DUI Conviction

A first conviction is charged as a Class B misdemeanor, punishable by jail time of forty-eight hours to six months, with a mandatory serving of at least forty-eight hours of the sentence, $750 to $1,000 in fines, a driver's license suspension of thirty days to one year, followed by an ignition interlock device, and mandatory alcohol/drug evaluation and counseling or treatment.

Second Conviction

A second conviction is charged as a Class A misdemeanor. Penalties include jail time of ninety days to one year, serving at least five days of that sentence (work release or house arrest is possible after 48 hours), fines of $1250 to $1750, a driver's license suspension of one year, followed by an ignition interlock device, and mandatory alcohol or drug evaluation and counseling or treatment.

Third Conviction

A third conviction is charged as a felony if a prior conviction was within the last 10 years. Otherwise, it is a Class A misdemeanor. Penalties include jail time of ninety days to one year, with at least ninety days of the sentence served (work release or house arrest is possible after 48 hours). Fines will be assessed between $1750 and $2500. A driver's license suspension of one year will be followed by an ignition interlock device as well as mandatory alcohol or drug evaluation and treatment or counseling.

    Steve Schanker ESQ, where do I begin? Having been raised by a prominent Trial Attorney and having several other family members as attorneys, as well as having attended Law School myself, however choosing management as my career instead of the law, I believe I have a great body of knowledge of how to determine a great lawyer. Steve has defended me in two different extremely challenging situations. The first time I met Steve was in an extremely stressful DUI situation. I had spoken with a number of attorneys about my situation and most did not want to take the case on. I had a BAC of .14 and was pulled over driving 102mph on highway 70. Steve told me it was not a wise decision, however he also said he could help me. End result was not losing my license, a few hours of community service, and a Suspended Imposition of Sentence (SIS) which equates to not being convicted. Incredible result that I probably did not deserve which effectively saved my career! The second time I hired Steve was an even better result.
